Oletrak Terms of Service

1. Agreement to these Terms

These Terms of Service ("Terms") form a legally binding agreement between you ("you" or "your") and Oletrak ("Oletrak", "we", "us" or "our"), the operator of the Oletrak online marketplace. By registering an account, browsing the marketplace, posting a listing, making a payment, or otherwise accessing or using the platform, you confirm that you have read, understood and agree to be bound by these Terms, together with our Privacy Policy.

If you do not agree with any part of these Terms, please do not use the platform.

2. Eligibility and Accounts

• You must be at least 18 years old to create an account and use paid features.
• You agree to provide accurate, current and complete information at registration and to keep it up to date.
• You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Enable two-factor authentication (2FA) in Settings for added protection.
• Each user may maintain a single account unless we agree otherwise. Duplicate or fraudulent accounts may be closed.
• Where enabled, you may sign in with your email and password or with a Google account. When you sign in with a third-party provider, you authorise that provider to share the email address and name on your account with Oletrak.
• If your account is banned or suspended, you may not create a new account to circumvent the restriction.

3. The Marketplace Services

Oletrak is a marketplace that connects buyers and sellers across Ghana. The platform supports the following listing types:

• Products — physical items for sale, with region and town/city location.
• Services — services offered by providers, with region and town/city location.
• Institutions & Rooms — hotels, schools and other institutions with bookable rooms and stays.
• Jobs — job postings with applications.
• Negotiable pricing — sellers may mark listings as price-negotiable, allowing buyers to make offers.

Every new listing passes through a moderation queue before it goes live, and Oletrak may remove or suspend listings that violate these Terms or the law.

Price Regulation

Oletrak uses statistical price-band monitoring (Median Absolute Deviation) to detect outlier pricing within each category. If a listing's price falls significantly outside the typical range for that category, it may be automatically flagged for admin review. Flagged listings are reviewed by the admin team before any action is taken. This helps maintain fair pricing across the marketplace while respecting legitimate price variation.

Seller Verification

Sellers may apply for verified seller status by submitting identification documents. Verified sellers receive a badge on their listings and profile, signalling trustworthiness to buyers. Verification is reviewed by the admin team and may be revoked if the seller violates platform rules.

Promotional Banners, Promos and Paid Memberships

Oletrak runs a unified promotions system covering the marketplace hero slideshow, the banner slots at the top of the products, services and institutions sections, and the wholesale teaser. Promotions are created and scheduled by Oletrak staff for sellers, campaigns and announcements. Where a promotion is described as running for a limited time, a limited number of spots or in a specific region or category, that description is set by the platform and shown on the promotion itself.

Some promotions are payment-gated memberships: you pay a one-time join fee through Paystack to unlock the promotion's benefits (for example, access to wholesale pricing). Your membership is recorded against your account and stays active under the terms shown when you joined. If a promotion has a spots limit, membership closes once that limit is reached. Join fees are non-refundable except where required by law or where Oletrak cancels the promotion before it starts.

Wholesale Pricing

Sellers may offer wholesale (bulk) pricing with minimum order quantities and tiered prices. Wholesale terms are set by the seller and are shown on the listing. Wholesale membership, where offered, requires a one-time fee as described above.

Coupons and Promo Codes

Sellers may create coupon codes that give buyers a discount on Secure Buy purchases or bookings. Coupons are funded by the seller, have a validity period, and may have usage limits. Oletrak validates every code at checkout against the live rules and may disable a code that is misused, misrepresented or that breaches these Terms.

Referrals and Wallet Credit

Oletrak may reward you for inviting new users. Referral rewards are credited to your Oletrak wallet, can be used to reduce the amount you pay at checkout, and are not redeemable for cash. Credit obtained through fake, duplicate or fraudulent accounts may be reversed.

Seller Analytics and Reports

Sellers get a dashboard showing listing performance — views, inquiries, saves, sales and ratings — plus an optional weekly analytics email. These figures are provided for information only and are based on events recorded while you were using the platform.

Wishlist

You can save listings to your wishlist for later. Wishlist items are private to your account, but sellers can see that an item has been saved as an aggregate count.

4. Listing Rules and Prohibited Content

When you post a listing or send any message, you agree not to:

• List items or services that are illegal, counterfeit, stolen, dangerous or otherwise prohibited by law;
• Post false, misleading or deceptive descriptions, images or prices;
• Use images or text you do not have the right to use;
• Use blocked words, hate speech, harassment, threats or discriminatory content;
• Attempt to conduct transactions outside the platform to avoid fees or protections;
• Misrepresent your identity, credentials or the condition of an item.

We may reject, suspend or remove any listing that breaches these rules and may suspend or permanently ban the responsible account.

5. Buying, Secure Buy Payments and Delivery

• Secure Buy: when you pay for a product or service through the "Secure Buy" option, your payment is held securely (by Oletrak, via Paystack) while the seller fulfils the order. The funds are not released to the seller until delivery is confirmed.
• Delivery & shipping: after payment, the seller marks the order as shipped and selects a delivery method (bus, ride-hail, Ghana Post, or in-person handover), optionally adding a waybill number or a dispatch photo as proof. Where delivery is arranged in person, buyers and sellers agree the meet-up details directly. Oletrak is not itself a carrier.
• Confirming receipt: when the item or service is handed over, you confirm receipt — normally with a one-time delivery code provided by the seller (or by marking the order as picked up). Your confirmation starts a cooling-off window (configurable by Oletrak, by default 72 hours) during which you can still cancel for a full refund.
• Auto-release: if you do not confirm or dispute, the funds are automatically released to the seller after the cooling window, or after the maximum hold period (by default 14 days) has elapsed — so a silent or inactive buyer cannot indefinitely block the seller's payout.
• Disputes: if something goes wrong, open a dispute from your Orders or Payments page before the funds are released. Oletrak support will review the evidence and either release the funds to the seller or refund the buyer. Decisions are final.

6. Fees and Commission

• Platform commission: a percentage of each Secure Buy or booking payout is deducted as the Oletrak platform fee before the seller receives their funds.
• Boosted listings: sellers may pay a fee to boost ("feature") a listing for 7 or 30 days for increased visibility.
• Job postings: a one-time fee applies to publish a job posting.
• Promotional banners and memberships: fees may apply for promotional banner placement, and a one-time join fee may apply to a payment-gated promotion or wholesale membership. The amount (if any) is shown on the promotion before you join.
• Coupons: discounts created by a coupon code are funded by the seller who created it, not by Oletrak.
• Referral credit: wallet credit earned from referrals is applied against your total at checkout. It is not cash, carries no cash value, and cannot be withdrawn.
• All fees are displayed before you confirm a payment. Fees are generally non-refundable once the service (e.g. a boost, banner placement or job publication) has been delivered, except where required by law.

7. Jobs and Applications

Job postings are paid listings that go live after payment. Job seekers may submit applications to posted jobs; employers review and respond to applications through the platform. Oletrak is not the employer and is not a party to any employment relationship formed through the platform.

8. Room Bookings and Stays

• Guests request bookings for rooms; owners approve or decline requests.
• Once approved, guests may pay to secure the booking. Funds are held and released to the owner when the stay is confirmed complete.
• Cancellation and refund rules follow each room's cancellation policy; owners may cancel paid bookings, in which case the guest is refunded.

9. Reviews and Ratings

Reviews must be truthful and based on genuine experience. We may remove reviews that are fake, abusive or otherwise violate these Terms. Sellers may never post reviews of their own listings.

10. Messages and Communication

User-to-user messaging lets buyers and sellers negotiate and transact. Messages are stored to keep a record of every deal. Sending unsolicited promotional messages, spam or abusive content is prohibited. Messages may be automatically deleted after the period configured by the platform.

Notifications and Digests

Order, payment, delivery and security updates are transactional and are sent because they are part of the service. Optional extras — daily or weekly marketplace digests, the weekly seller analytics report and browser (push) notifications — are only sent when you turn them on, and you can switch them off at any time in Settings or through your browser's notification settings.

11. Intellectual Property

The Oletrak name, logo, design, software and content are owned by Oletrak or its licensors. You may not copy, scrape, resell or misuse the platform or its content. You retain ownership of the content you post, and grant Oletrak a non-exclusive licence to host and display that content to operate the marketplace.

12. Prohibited Uses

• Attempting to gain unauthorised access to accounts or systems;
• Automated scraping, crawling or bulk extraction of listings or user data;
• Impersonating another person or entity;
• Using the platform for any unlawful purpose;
• Interfering with the operation, security or integrity of the platform;
• Manufacturing impressions or clicks on promotions, or otherwise manipulating listing or promotion statistics;
• Abusing coupon codes, referral rewards or wallet credit (for example through self-referral or duplicate accounts);
• Reselling, sublicensing or transferring a paid promotion or membership to another person without our written consent.

13. Disclaimer and Limitation of Liability

The platform is provided "as is" and "as available". Oletrak does not guarantee that listings are accurate, that items exist, or that any buyer-seller agreement will be completed, except for the Secure Buy protections described in Section 5. To the maximum extent permitted by law, Oletrak's total liability arising out of or in connection with the platform is limited to the fees you paid to Oletrak in the 12 months preceding the claim.

14. Suspension and Termination

We may suspend or terminate your account at any time if you breach these Terms, violate the law, or if we believe your conduct harms the community or the platform. You may delete your account at any time through your profile settings. Termination does not affect existing Secure Buy, booking or dispute obligations.

15. Changes to These Terms

We may update these Terms from time to time. We will post the updated version on this page and update the "Last updated" date. Continued use of the platform after changes take effect means you accept the updated Terms.

16. Governing Law

These Terms are governed by the laws of the Republic of Ghana. Any dispute arising from these Terms or the platform will be subject to the exclusive jurisdiction of the courts of Ghana.

17. Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Any dispute, controversy, or claim arising out of or relating to these Terms, the platform, or the breach, termination, or invalidity thereof (a "Dispute"), shall first be resolved through good-faith negotiation. If the parties cannot resolve the Dispute within thirty (30) days of written notice, either party may submit the Dispute to binding arbitration administered by the Alternative Dispute Resolution Centre (ADRC) of Ghana in accordance with its Arbitration Rules then in effect.

Scope. Arbitration shall apply to all Disputes between you and Oletrak, including but not limited to claims arising from transactions on the platform, account-related issues, privacy concerns, and any interpretation of these Terms.

Exceptions. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's intellectual property rights or confidential information. Either party may also bring an individual action in small-claims court for Disputes within that court's jurisdiction.

Class Action Waiver. You agree that any arbitration or court proceeding shall be conducted on an individual basis and not as a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against Oletrak.

Arbitrator's Authority. The arbitrator shall have exclusive authority to resolve all Disputes, including the scope and enforceability of this arbitration provision. The arbitrator's decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

Costs. Each party shall bear its own costs and attorneys' fees in any arbitration, except that the arbitrator may award costs and fees to the prevailing party as permitted by applicable law.

Opt-Out. You may opt out of this arbitration provision by sending written notice to Oletrak at support@oletrak.com within thirty (30) days of first accepting these Terms. Your notice must include your name, account email, and a statement that you wish to opt out of arbitration. If you opt out, neither you nor Oletrak may require the other to participate in an arbitration proceeding.
